At Basis Cost Segregation, LLC, we strive to honor the privacy and security of our users, customers, partners, and suppliers, as well as their representatives, in relation to all products, services, applications and websites provided by Basis Cost Segregation, LLC, LLC ("Basis," "we," "us," or "our"), when acting as a Data Controller under relevant data protection rules and regulations.

Privacy Policy

We value your trust and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and safeguard your data when you use our services.

This Policy applies to information collected through our public website, customer application, report intake process, customer support communications, and related online services. Some categories of information described below may apply only if you create an account, submit report information, upload documents, or purchase services. The Privacy Policy sets forth how Basis Cost Segregation, LLC collects, uses, retains, and shares information when you use our website, application, and cost segregation report services. About This Policy

This Privacy Policy (“Policy”) describes how Basis Cost Segregation, collects, uses, retains, and shares information when you use our website, application, and cost segregation report services. This applies to all customers, including sole proprietors and individual property owners who submit information directly in their own name.

Our services are intended for users and properties in the United States only. We do not knowingly offer access to users outside the United States.

For purposes of this Policy, “personal information” means information that identifies, relates to, describes, or can reasonably be associated with an identifiable individual or household, subject to applicable law.

Information Collected and Personal Data Processed

We collect information you voluntarily provide or submit through our website and applications including, when you create an account, complete intake forms, upload documents, communicate with us, or purchase services. This includes account and contact information, including name, email address, and login credentials; property information, including address, acquisition date, purchase price, and cost basis details; report intake answers and supporting documents you choose to upload; payment and transaction records, including purchase status, receipt details, and service history; and communications with our support team.

Financial Data Collected

We may receive limited information from service providers, such as payment status from Stripe, authentication or account-status information from Supabase, and technical or diagnostic information from hosting, security, logging, or support providers. We do not purchase customer personal information from data brokers.

We automatically collect and record limited technical, device, and usage information when you use the service, including IP address, browser and device type, pages or features accessed, timestamps, authentication events, diagnostic logs, and error logs. The information is used to operate, secure, debug, and improve the service.

We do not collect, receive, process, or store financial account credentials, credit card numbers, CVV codes, or Social Security Numbers through our application. All payment card information is processed directly by Stripe or other authorized payment processors and BASIS does not receive or retain full payment card information.

Purpose for Collecting or Processing Data

Personal data is collected and processed to support the following business, operational, and legal purposes:

  • Prepare cost segregation estimates and reports;
  • Operate, maintain, secure, and improve the application;
  • Communicate with you about your account, reports, payments, and service updates;
  • Maintain business, legal, tax, audit, and report records;
  • Investigate suspected misuse, fraud, or security incidents; and
  • Comply with applicable legal obligations.

Basis does not collect, solicit, store, retain, process, or maintain customers property details, report inputs, uploaded documents, or generated reports for advertising, marketing, lead generation, data brokerage, or AI / machine learning model training.

How We Share Information

We may disclose your Personal Information to any member of our group of companies, affiliates, as reasonably necessary for the purposes, and on the legal bases, set out in this Privacy Statement.

We do not sell personal information and do not share personal information for cross-context behavioral advertising If that practice ever changes, we will revise this policy accordingly and provide any legally required opt-out rights before the change takes effect.

Basis does not share customer information with third parties for advertising, marketing, lead generation, cross-context behavioral advertising, or data brokerage purposes.

Who Data is Shared with - Service Providers

We share information with service providers who help us operate, secure, and support the application. These providers are authorized to use your information only as needed to perform services for Basis. Current service providers include:

  • Supabase, for authentication and database infrastructure.
  • Stripe, for payment processing when paid services are enabled.

Hosting, logging, diagnostics, customer support, communications, database services, application security, accounting, legal compliance, and business-operations providers as needed for operations.

Other Third Parties Who Data May Be Shared With

We may share information with Basis's own attorneys, accountants, or auditors when required for legal compliance, audit, or business operations. These parties are subject to confidentiality obligations and are not authorized to use your information for any other purpose.

We may disclose information if required by law, subpoena, court order, or regulatory authority, or where we believe disclosure is necessary to protect the rights, safety, or property of Basis, our customers, or others.

Business Transfers and Acquisitions

If Basis is acquired by, merged with, or transferred to another company, we will provide affected customers with at least 30 days' advance written notice before their data is transferred to or becomes subject to a different privacy policy. During that notice period, customers may request deletion of their information by contacting Support@basiscostseg.com. Any successor entity will be required to honor the commitments in this policy with respect to previously collected information or provide customers the opportunity to delete prior to any material change.

Data Retention

We will not retain your Personal Information for longer than necessary for the purposes for which it was collected as set out in this Privacy Statement. In determining data retention periods, we take into consideration local laws, contractual obligations, our reasonable business requirements, and your expectations and requirements. When it is no longer necessary to retain your Personal Information, we will securely delete it or anonymize it in accordance with applicable Privacy Laws.

We retain different categories of information for different periods based on their purpose:

Generated cost segregation reports: Retained indefinitely. We retain completed reports and the records needed to support, reproduce, and defend them for as long as reasonably necessary for legal, tax, and audit purposes.

Raw intake data and uploaded documents: Retained for one year following delivery of your completed report, then deleted. We retain this window to support follow-up questions during your tax filing cycle.

Account and transaction records: Retained for as long as your account is active and for a reasonable period thereafter, as required for legal, tax, accounting, fraud prevention, and business record purposes.

Technical and log data: Retained for a limited period as needed for security monitoring, debugging, and operational purposes.

When deletion is required, we will delete or de-identify information in accordance with these periods, subject to legal holds, dispute resolution, or other obligations that require temporary extension.

Customer Rights Regarding Access to Control Over Personal Information

Depending on where you live, applicable state privacy laws may give you rights to request access to, correction of, deletion of, or portability of your personal information. Basis supports these rights for all customers regardless of state.

Data subject access requests apply to all individuals regardless of whether your state has passed any privacy laws.

Access: A Customer may request confirmation of whether Basis Cost Segregation is processing the Customer's personal data and access to that data.

Corrections: A Customer may request correction of inaccuracies in the Customer's personal data, taking into account the nature of the data and the purposes for processing it.

Deletion: A Customer may request deletion of personal data provided by or obtained about the Customer.

Portability: A Customer may request a copy of personal data previously provided to Basis in a portable and, to the extent technically feasible, readily usable digital format.

Opt Out: A Customer may opt out of processing for targeted advertising, the sale of personal data, or profiling in furtherance of a decision by Basis Cost Segregation that produces a legal or similarly significant effect.

Basis does not currently sell personal data, use personal data for targeted advertising, or make such decisions through solely automated profiling, but a Customer may still submit an opt-out request, and Basis will respond as required by law.

Basis will not discriminate or retaliate against a Customer for exercising an applicable privacy right.

Privacy Requests

To make a request, contact us at Support@basiscostseg.com. Please use the subject line "Privacy Request" and identify the right the person wishes to exercise. We will respond within a reasonable time. We may verify your identity before processing a request. We may retain information where required or permitted for legal, tax, audit, security, fraud prevention, dispute resolution, or report-support purposes, even where a deletion request is made.

Authentication

A person is not required to create a new account to submit a privacy request, although Basis may require the use of an existing account when reasonably appropriate to authenticate a request concerning that account.

Do not send a Social Security number, driver's-license number, copy of a government-identification document, full Customer report, financial-account number, or other highly sensitive information in the initial email or web-form submission.

If additional information is reasonably necessary to authenticate the requester or locate the relevant records, Basis will provide instructions for a more secure exchange.

An authorized agent may submit an opt-out request on a Customer's behalf when permitted by law, and Basis may use commercially reasonable methods to verify the Customer's identity and the agent's authority.

Appeals

If Basis declines a request, Basis will provide the justification and instructions for appealing the decision.

To appeal, send an email to Support@basiscostseg.com with the subject line "Privacy Appeal" or use the online contact form and begin the message with "Privacy Appeal."

Basis will provide a written decision on the appeal in a reasonable period after receiving the appeal.

If Basis denies an appeal, the response will explain the decision and provide information about submitting a complaint through the Texas Attorney General's privacy complaint form.

Exceptions and Other Rights

The rights described in this Privacy Policy do not apply to every person or every category of data.

Texas law contains exceptions for certain Fair Credit Reporting Act-regulated activity, employment-context data, business-to-business activity, and other information or processing.

The responsible Client may control data submitted through the Services, and a request concerning that data may need to be directed to the Client.

Residents of other states may have similar or additional rights under applicable law and may use the same request methods described in this Privacy Policy.

United States Services and Children

The Services are offered for use in the United States, and personal data may be processed and stored in the United States.

Basis Protection Portal accounts are limited to Client’s authorized administrators who are at least 18 years old.

The current Services are not directed to children under 13, and Basis does not knowingly permit a child under 13 to create a Basis Protection Portal account.

If Basis introduces a service that directly collects personal data from a known child under 13, Basis will provide any required child-specific notice and obtain verifiable parental or guardian consent before processing the child's personal data.

A parent or legal guardian may exercise applicable privacy rights on behalf of a known child.

Cookies And Similar Technologies

Our Sites use Cookies and other similar technologies in accordance with applicable Privacy Laws. Cookies are text files containing small amounts of information which are downloaded to your device when you visit a website. Cookies help with a variety of website functions including allowing users to “log in” to websites (making your navigation of websites more efficient), remembering your preferences (such as language), and generally improving your experience on our Sites.

We use cookies, local storage, session storage, and similar technologies to keep the application functioning, maintain login and session state, support security, support basic preferences, and understand service performance at an aggregate level and for diagnostics. We do not use cookies or similar technologies to sell personal information or share customer information for advertising or cross-context behavioral advertising. You may manage cookie settings through your browser, but disabling certain technologies may affect login functionality or application security.

Where available, a person may use the website's cookie controls to decline nonessential cookies, and browser settings may also block or delete cookies.

Blocking some cookies may affect website functionality.

Security

There is no perfect security. We have implemented appropriate and commercially reasonable organizational, technical, and administrative safeguards to protect Personal Information. You are responsible for maintaining the confidentiality of your login credentials. If you believe your account has been compromised, contact us immediately at Support@basiscostseg.com.

Links to Third Party Sites

We are not responsible for the practices employed by any websites or services linked to or from the Sites, including the information or content contained within them. We encourage you to investigate and ask questions before disclosing Personal Information to third parties, since any Personal Information disclosed will be subject to the applicable third party’s privacy policy.

No Tax Or Legal Advice

Basis prepares cost segregation reports and related support materials. We do not provide legal, tax, accounting, investment, or CPA advice. Consult your CPA, tax advisor, or attorney before relying on any report for tax filing, audit response, financial planning, or other decisions.

Changes To This Policy

We reserve the right, at our sole discretion, to change, modify, add, or remove portions from this Privacy Statement at any time. We shall notify any such changes in accordance with applicable Privacy Laws. The updated version will be posted with a new effective date. If we make material changes affecting how we collect, use, or share your information, we will provide advance notice through the application, email, or other reasonable means before the changes take effect.

If a proposed material change is unacceptable to you, you may request deletion of your information before the change takes effect by contacting Support@basiscostseg.com.
